The Balkan Botanical Garden of Kroussia mobile application development is part of the implementation of the project entitled “Modernization of the ELGO guesthouse & innovative interventions along the trail to highlight the biodiversity of the area as part of the development of a gamified awareness-raising application awareness” (code OPSAA 0045934674), CLLD/LEADER within the framework of Sub-measure 19.2 of the RDP 2014-2020, implemented at the Institute of Genetic Improvement and Plant Genetic Resources, with OTS Code: 20.2247.201, CPV: 72262000-9. The mobile application is managed by the company, Kimatica Ltd.
Kimatica, is committed to protecting and respecting your privacy. The below privacy policy explains how Kimatica ( we , us ) may collect, store, and process your data, for which purpose, and what are your data protection rights
Your privacy is considered to be of utmost importance to Kimatica, (the Company , we , or us ). Kimatica as a Data Controller, is committed to protecting the personal data you share with us. This Privacy Policy explains how we collect, use, share and protect information about you. We also provide information regarding how you can access and update your information and make certain choices about how your information is used.
Our mobile application complies with the relevant Greek legislative framework and the General Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data ( GDPR Regulation ).
The Privacy Policy covers both our online (e.g., web and mobile services however accessed and/or used, whether via personal computers, mobile devices, or otherwise) and offline (e.g., collection of data through mailings, telephone, or in person) activities owned, operated, provided, or made available by the Company. Our online and offline activities are collectively referenced as the Services.

Important Definitions concerning the referrals to the GDPR Regulation:

Information we collect and use of cookies
(a) Information You Provide to Us Personal Information. We may ask you to provide us with certain categories of information such as personal information, which is information that could reasonably be used to identify you personally, such as: i. Name, ii. E-mail address and iii. Mobile number ( Personal Information ). We may collect this information through various forms and in various places through the Services, including account registration, or when you otherwise interact with us or other users. When you sign up to use the Services, you create a user profile that may require you to provide: i. Name, ii. Phone number(s), iii. E-mail address, iv. Password, v. Postal code, vi. Credit card number, expiration date & security code, or information regarding your PayPal, Google Wallet, or other digital payment accounts. Information about your payment accounts is not held by the Company. We use a third-party payment processor to handle all contributions made through the Services. If you choose to upload photos when registering for our Services, the photos may be viewable by us and by other users. You may remove or update photos at any time by logging into your account. (b) Information We Collect as You Access and Use Our Services In addition to any Personal Information or other information that you choose to submit to us, we and our third-party service providers may use a variety of technologies that automatically (or passively) collect certain information whenever you visit or interact with the Services ( Usage Information ). This Usage Information may include the browser that you are using, the URL that referred you to our Services, all of the areas within our Services that you visit and the time of day, among other information. We may use Usage Information for a variety of purposes, including to enhance or otherwise improve the Services. In addition, we collect your IP address or other unique identifier ( Device Identifier ) for your computer, mobile or other device used to access the Services (any, a Device ). A Device Identifier is a number that is automatically assigned to your Device used to access the Services and our computers identify your Device by its Device Identifier. Usage Information may be non-identifying or may be associated with you. Whenever we associate Usage Information or a Device Identifier with your Personal Information, we will treat it as Personal Information.

Web Beacons. Small graphic images or other web programming code called web beacons (also known as 1×1 GIFs or clear GIFs ) may be included in our web and mobile pages and messages. The web beacons are tiny graphics with a unique identifier, similar in function to cookies and are used to track the online movements of Web users. In contrast to cookies, which are stored in a user s computer hard drive, web beacons are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. (d) Information You Provide About a Third Party If you choose to use our referral service to tell a friend about our Services, we will ask you for your friend s name and email address. We will automatically send your friend a one-time email inviting him or her to visit the Services. We store this information for the sole purpose of sending this one-time email and tracking the success of our referral program and do not use this information for any other marketing purpose unless we obtain consent from that person or we explicitly say otherwise. Legitimate basis for the processing of your personal data (for EU citizens)
Kimatica collects only the personal data that are necessary to meet your requests. Whenever additional, optional information is sought, you will be notified when this data is collected and your prior consent for processing may be required. The GDPR Regulation allows us to process personal data only if we have the legal basis for doing so. We also need to let you know the reasons for this. Therefore, when processing your personal data, we rely on one of the following processing bases: Consent: Your consent may occasionally be requested in order to process some of your personal data. Your data will be processed in this way only if you explicitly agree to this (Article 6 (1a) of the GDPR Regulation). Execution of a contract: Where processing of your personal data is necessary to fulfil our obligations arising out of a contract (Article 6 (1b) of the GDPR Regulation). Legal obligation: This is the case where we are obliged to process your personal data in order to comply with a legal obligation, such as, but not limited to: (a) keeping records for tax purposes, (b) providing information to a public body, (c) (Article 6 (1c) of the GDPR Regulation) comply with the requirements of a legislative or regulatory provision. Protecting your vital interests: This is the case when processing your personal data is necessary to protect your vital interests (Article 6 (1d) of the GDPR Regulation). Fulfilment of a duty performed in the public interest: This is the case when the processing of your personal data is necessary for the performance of a duty performed for the public interest (Article 6 (1e) of the GDPR Regulation). Legitimate interest: We may process your personal data in cases where this processing is a legitimate interest of our company in performing a legitimate activity in order to ensure the continuity of this activity. This processing, of course, will not go beyond your interests, freedoms and fundamental rights (Article 6 (1f) of the GDPR Regulation). Kimatica collects special categories of personal data as defined in Article 9 of the GDPR Regulation when the natural persons themselves, without our own claim, provide us with such data or when the data are required or their collection is permitted by law. The concept of “special category” personal data includes personal data relating to a person’s race, nationality, political beliefs, participation in trade unions, his religious beliefs, his philosophical beliefs, his physical or mental health, sex and orientation, data on criminal convictions and offenses. We ve assessed that the legal bases for using your personal information as set out in this notice are as follows: a. Contract our use of your personal information is necessary to perform our obligations under any contract we have with you; or b. Legal Obligations our use of your personal information is necessary for complying with our legal obligations; or c. Our Legitimate Interests to: i. Run, grow and develop our business; ii. Detect and prevent fraud; iii. Enhance the security of our network and information systems; iv. Ensure that our own processes, procedures and systems are as efficient as possible; v. Better understand how people interact with our mobile application; vi. Analyse and enhance the information that we collect; vii. Determine the effectiveness of our promotional campaigns and advertising; and viii. Enhance, modify, personalize or otherwise improve our services and communications for the benefit of our donors. d. Consent We rely on your consent to use your personal information to send you marketing information and newsletters by email or SMS.

Other purposes for processing personal data
We do not process your personal data for any other purpose than we ve described here. As we develop our activities and services, we might add new data processes that use your personal information. Should we decide that we want to develop a new processing purpose, we will contact you to let you know what we intend to do, the lawful basis we will use, and your rights over our intended new processing.

How we use collected information
Our primary goal in collecting your Personal information or Usage Information is to provide you with an enhanced experience when using the Services. Based upon the Personal Information you provide us when registering for an account, we will send you a welcoming email to verify your username and password. We will also communicate with you in response to your inquiries, to provide the services you request and to manage your account. We will communicate with you by email, telephone, or SMS or text message, in accordance with your wishes. We use your information to closely monitor which features of the Services are used most, to allow you to view your campaign or contribution history, view any incentives that may currently be available and to determine which features we need to focus on improving, including usage patterns and geographic locations to determine where we should offer or focus services, features and resources. We use your Internet Protocol (IP) address to help diagnose problems with our computer server and to administer our web site(s). Your IP address is used to help identify you, but contains no personal information about you. We will send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if our Services are temporarily suspended for maintenance, we might send you an email. Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account. In addition, we may use your Personal Information or Usage Information that we collect about you: i. To provide you with information or services or process transactions that you have requested or agreed to receive including to send you electronic newsletters, or to provide you with special offers or promotional materials on behalf of us or third parties. ii. To process your registration with the Services, including verifying your information is active and valid. iii. To improve the Services or our services, to customize your experience with the Services, or to serve you specific content that is most relevant to you. iv. To contact you with regard to your use of the Services and, in our discretion, changes to the Services and/or the Services policies. vi. For internal business purposes. vii. For inclusion in our data analytics. viii. For purposes disclosed at the time you provide your information or as otherwise set forth in this Privacy Policy. Please note that information submitted to the Services via a contact us or other similar function may not receive a response.

How we protect your personal data
The personal data processing is conducted in a way that ensures its confidentiality. Specifically, the processing is only carried out exclusively by authorized for this purpose personnel, while taking all appropriate organizational and technical measures for data security and protect them against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access and all other form of illicit processing.

Confidentiality
All staff shall be subject to an obligation of confidentiality, all processors of personal data on behalf of Kimatica and processing contractors are required to sign a data processing agreement and compliance with the GDPR Regulation. We currently don t have any third party acting as a data processor. When authorized personnel have access to personal data, this access is possible only through an encrypted connection. When accessing data in a database, the IP address of the person who has access to the data must also be authorized. Devices that temporarily store personal data are always, except when not used or transferred, locked in a safe place. Personal data is never stored on mobile media like USB stick, CD and DVD.

Integrity
To ensure integrity, all data passages are encrypted to align with best practices to protect confidentiality and data integrity. The information is encrypted through the application of appropriate security measures (Secure Socket Layer) and then encrypted in the database maintained by Kimatica to be accessible to those who have authorized access to such systems and are required to keep confidential information.

Availability
Information systems are designed to offer the high availability of the services provided to Kimatica. High Availability (HA) is a feature of a system that aims to ensure a high level of business performance. Availability refers to the ability of the user community to acquire a service or good quality access to the system, either to submit new data, update or change existing variables or to collect the results of previous actions.

Transparency
Kimatica will inform you at any time about changes to privacy and security procedures, including company practices and policies. You can always ask for information about where and how your data is stored, how it is secured, and how it is used. Ability to intervene Kimatica provides subjects with access rights, deletions, objections and oppositions. The overall responsibility for the security of the data lies on the administration staff of Kimatica, who educate and inform all personnel of the company, on data security measures as stated in this Privacy Policy. Grading Access to personal data is blocked by default, using a zero privilege policy. Access to personal data is restricted to authorized personnel. Tracking Kimatica uses security reports to monitor access patterns and to identify and limit possible threats. Administrative functions, including access to the system, are recorded to provide the necessary control to record unauthorized or accidental changes. The performance and availability of the system are monitored by both internal and external monitoring services. Notification of violation of personal data If your data is violated, Kimatica will notify you, and the competent Data Protection Authority within 72 hours via e-mail or other appropriate means, would provide information about the extent of and the affected data. It is furthermore clear that it will take any action necessary to limit any harmful consequences for the data subjects.

Location of collection and processing of personal data
The Personal Data of the subjects collected by Kimatica are collected, stored and processed at the headquarters of the company at D. Glinou 5, Halkida, 34100, Greece, as well as the Microsoft Azure Information Systems Hosting Services provider on the servers (servers) to be transmitted only for the purpose of storing data collected from Kimaticas mobile application. Additionally, platforms are used by newsletter delivery service providers.
Disclosure or share of information to third parties
We may share non-personally identifiable information, such as aggregated user statistics and log data, with third parties for industry analysis, demographic profiling, to deliver targeted advertising about other products or services, or for other business purposes. We do not sell, share, rent, or trade the information we have collected about you, including Personal Information, other than as disclosed within this Privacy Policy or at the time you provide your information. We do not share your Personal Information with third parties for those third parties’ direct marketing purposes unless you consent to such sharing at the time you provide your Personal Information. To opt out of receiving marketing messages, or to object to our use of profiling for direct marketing purposes, contact us at any time at support@kimatica.com.
(a) When You Agree to Receive Information from Third Parties. You may be presented with an opportunity to receive incentives, information, or marketing offers directly from third parties. If you do agree to have your Personal Information shared, your Personal Information will be disclosed to such third parties and all information you disclose will be subject to the privacy policy and practices of such third parties. We are not responsible for the privacy policies and practices of such third parties and, therefore, you should review the privacy policies and practices of such third parties prior to agreeing to receive such information from them. If you later decide that you no longer want to receive communication from a third party, you will need to contact that third party directly.
(b) Third Parties Providing Services on Our Behalf. We use third-party companies and individuals to facilitate our Services, provide or perform certain aspects of the Services on our behalf – such as drivers and companies they work for to provide the Services and other third-parties to host the Services, design or operate the Services features, track the Services analytics, process payments, engage in anti-fraud and security measures, provide support, enable us to send you special offers, host our job application form, perform technical services, or perform other administrative services. We may provide these vendors with access to user information, including Personal Information, this information sharing is limited to only the information needed by the vendor to carry out the services they are performing for you or us. Each of these vendors is obligated not to disclose or use Personal Information for any other purpose. While we may use third-party analytics service providers to evaluate and provide us with information about the use of the Services and viewing of our content, we do not share Personal Information with these analytics service providers. Still, they may set and access their cookies, web beacons and embedded scripts on your Device. They may otherwise collect or have access to information about you, including non-personally identifiable information. We use a third-party hosting provider who hosts the support section of our mobile application. Information collected within this section of our mobile application is governed by our Privacy Policy.
(c) Sweepstakes, Contests and Promotions. We may offer sweepstakes, contests and other promotions (any, Promotion ) through the Services that may require registration. By participating in a Promotion, you are agreeing to official rules that govern that Promotion, which may contain specific requirements of you, including, allowing the sponsor of the Promotion to use your name, voice and/or likeness in advertising or marketing associated with the Promotion. If you choose to enter a Promotion, Personal Information may be disclosed to third parties or the public in connection with the administration of such Promotion, including, in connection with winner selection, prize fulfilment and as required by law or permitted by the Promotion s official rules, such as on a winners list.

Your rights under the GDPR regulation (for eu citizens)
The GDPR Regulation gives you the following rights regarding the processing of your personal data:
Right of Access: You may request access to your personal data. This gives you the opportunity to receive a copy of your personal data maintained by Kimatica.
Right of Correction: You may request a correction of your personal data. This allows you to correct any incomplete or inaccurate data you have with Kimatica. In this case, we will need to verify the accuracy of the new data you provide us.
Delete Right: You can request the deletion of your personal information. This allows you to ask us to delete or remove personal data if there is no reason to continue processing it. Please note, however, that your entitlement may in certain circumstances not be possible for specific legal reasons to be communicated to you, as appropriate, at the time of your request.
Right to Limitation of Processing: You may request a limitation of the processing of your personal data. In particular, you may ask us to stop processing your personal data in the following cases:
(a) If you want to redefine the accuracy of your personal data,
(b) when you believe that the use of your data is abusive, but you do not want to delete your data and
(c) when we need to keep your data, even if we do not require it from you anymore, in order to be able to use it in the event of a potential exercise of your rights.
Opposition: You may oppose the processing of your personal data at any time in cases where the processing of your data is based on the fulfillment of a duty performed in the public interest or in the exercise of official authority (Article 6 (1) of the GDPR), or if the processing fulfills the legitimate interests of Kimatica or a third party (Article 6 (1) (f) of the GDPR). However, Kimatica may not satisfy your right to do so if it demonstrates imperative and legitimate processing grounds that override your interests, rights and freedoms, or the foundation, exercise or support of legal claims.
Portability: You may request the transfer of your personal data to you or to third parties. We will provide you with your personal data in a widely used, electronically-readable form. Please note that this right applies only to automated information that you originally provided us with your consent to use or whenever we used this information to perform a contract with you.
Right of Withdrawal of Consent: You may withdraw your consent at any time in cases where you have already given your consent to the processing of your personal data. However, this will not affect the legitimacy of any processing that took place before the withdrawal of your consent. If you withdraw your consent, Kimatica may not be able to offer you certain products or services. You will be informed about this at the time of your request.
Manual decision-making: Automatic decision-making takes place when an electronic system uses personal data to decide without human intervention. In this case, you have the right not to make decisions taken solely through automated processing including profile training that produces legal effects affecting you or that significantly affect you in a similar way unless you give us your consent or is necessary for the conclusion or performance of a contract between you or otherwise permitted by law. You also have the right to challenge decisions taken in connection with you through the above procedure.

Publicly disclosed information
(a) User Generated Content and Public Information. The Services may offer publicly accessible blogs or community forums or other ways to permit you to submit ideas, photographs, user profiles, writings, music, video, audio recordings, computer graphics, pictures, data, questions, comments, suggestions or other content, including Personal Information (collectively, User Content ). We or others may reproduce, publish, distribute or otherwise use User Content online or offline in any media or format (currently existing or hereafter developed). Others may have access to this User Content and may have the ability to share it with third parties across the Internet. You should be aware that any User Content you provide in these areas may be read, collected and use by others who access them. Thus, please think carefully before deciding what information you share, including Personal Information, in connection with your User Content. Please note that Company does not control who will have access to the information that you choose to make public and cannot ensure that parties who have access to such publicly available information will respect your privacy or keep it secure. This Privacy Policy does not apply to any information that you disclose publicly, share with others or otherwise upload, whether through the Services or otherwise. We are not responsible for the accuracy, use, or misuse of any content or information that you disclose or receive through the Services. To request removal of your User Content from our Services, you may contact us. In some cases, we may not be able to remove your User content, in which case we will let you know if we are unable to do so and why. (b) Name and Likeness. Third-party content and links to third-party services
The Services may contain content that is supplied by a third party and those third parties may collect mobile application usage information and your Device Identifier when web pages from any online Services are served to your browser. In addition, when you are using the Services, you may be directed to other sites or applications that are operated and controlled by third parties that we do not control. We are not responsible for the privacy practices employed by any of these third parties. These other Mobile applications/websites may send their own cookies to you, independently collect data or solicit Personal Information and may or may not have their own published privacy policies. We encourage you to note when you leave our Services and to read the privacy statements of all third-party web sites or applications before submitting any Personal Information to third parties.
